SRS What would you guys do in this situation? (anonymous post)

    Friend charged with 5 felonies.
    Not guilty of charges. Has 2 witness on side but also 2 witnesses against.

    Option 1:
    Go to Trial
    60/40 chance of winning
    if lose trial, definite jail time, probably at least 4-8 yrs, and possibly registry as sex offender


    Option 2:
    Plea deal
    1 felony count that will be reduced to misdemeanor after probation
    Jail time possible but at most 6 mths and realistically no jail time



    I think option 2 is the better choice. Chance of winning the trial but it seems too risky. Problem is pleading to something, it is hard when the person knows they are innocent.

    option 2, for sure. especially if he doesn't have to register as a sex offender. if the plea is a sure thing with reduced charges and everything....and "realistically" no jail time? thats a sweetheart deal compared to a conviction. and just imagine if that 40% likelihood of conviction came down on judgment day and those words "guilty" came out of the jury foreman's mouth? just gotta consider that a little...that would be crushing to his life and many who know him, no doubt

    no time to be proud or righteous about this. his innocence in his own mind needs to be enough in this situation. take the plea and move on. quickly

    If it's really 60/40 I'd take the plea.

    What's the felony that he'd end of having on his record? Not having to register as a sex offender would be the best part of the 2nd option.

    Option 1...if I'm not guilty of something, they can stick their plea deal, which would result me receiving jail time anyway, up their asses.

    Depends on what he has already said to police and what kind of funds are available for a lawyer.

    and is this state or federal? At least in federal court if your friend has already been charged with 5 felonies it's possible that even if the pros drops 4 of the charges he could get "related conduct" sentencing and serve the same amount of time for 1 charge as he would have for 5 (up to stat max)

    plus the judge doesn't have to accept the plea

    point being, hopefully he already has a very good lawyer advising him. he has no business entering into plea negotiations w/o a lawyer. and if he has a laywer he should be relying on his lawyer for advice not us.

    So it says "Not Guilty of Charges."
    Is that hearsay or can you trust that its true. If he is really truthfully not guilty, then fight it.

    If he is Guilty then take a plea deal. Just my opinion.

    and i'm a little fishy about the "possible registry as a sex offender." i don't see how they'd offer a plea and NOT include that.

    i guess i need a little more information about how this person got charged with 5 felonies.

    Also another good question would be what State is this in. As bad as it sounds some states are more lenient then others.
