As well as the whole pen thru trigger guard? I've seen many pics here like that.
When in battery the barrel and slide lock together. As the bullet is expelled, the barrel/slide both move backwards in reaction. However, the bottom of the barrel catches on a block which pulls the back of it down and out of contact with the slide, which continues to move backwards. This results in the barrel being canted upward. Mess around with this to see it in action: http://www.sniperworld.com/glock/
Pen through the trigger guard is so that the gun isn't lying flat on the table/ground/whatever, which would look crappy.
you should probably return that pen to your doctors office
He may be in the medical industry, my wife was a medical assistant for a couple years and she accumulated TONS of pens like that.

Attention new FNP-9 owner, quick note to remember.
Please note your picture #1, anytime you are breaking the gun down for cleaning make sure the notch and the button your depress to break the gun down match(like in the pic), if it doesn't it will scratch the upper piece up as the button will rub.
I found this out the hard way on my all black FNP-9 and it was my dumbass fault for not following the instructions properly.
NOTE: If my post doesn't make sense I apologize, I just got back from Australia after spending 2 days in the airport to get back and my brain isn't working good.
