MIL underage drinking

    does anyone know what article of the ucmj underage drinking falls under? and what it altually says about it. ive been looking and cant find shit

    1. put "ucmj underage drinking" in google and the first website pops up is an army guide for counseling underage drinking. it says Article 134 of the Uniform Code of Military Justice

    2. put "Article 134 of the Uniform Code of Military Justice" into google and you got an exact copy from Navy JAG

    after reading it a bit more i'm wrong.

    134 is the general order catchall

    being drunk would fall under disorderly conduct/drunkenness covered in 134

    the UCMJ technically does not have a provision for saying the age limit for purchasing alcohol as that is something the federal government controls. you have to abide to whatever law you are in.

    failure to abide by this lawful order shall be considered a violation of Article 92, of the UCMJ, and may be subject to non-judicial punishment under the provision of Article 15

    if you're trying to argue you way out of being punished for underage drinking.... i don't know what to tell you.

    drinking age on base is determined by the base CO
    off base is covered by civilian laws

    that is what I remember anyway.

    If you are in the US drinking age is 21. Doesn't matter if it's on base or off.

    many people agree with this sentiment...especially some of the older guys who remember the days of liquid lunches, and underway drinking from shampoo bottles. Sadly however policy>>>>> old salts

    Federal drinking age is 18. ALL states mandate a 21y/o drinking age. Most post commanders (as Posts are Federal Property) mandate a 21y/o drinking age. Wyoming was the last holdout state in the Fed Gov's attempt to control state drinking through loss of federal funding...that was back in the 80's when it was 19 to drink beer.

    Back in the day...colorado had a 19y/o hard alcohol / beer rule and nebraska had a 18 y/o beer rule and 21 y/o hard alcohol rule. So all the 18y/o's were driving to Nebraska for legal beer and all the 19y/o's from nebraska were driving to colorado for hard alcohol. Made for some unpleasant crashes on that deserted 2 lane highway.

    many states are considering laws to dicriminalize the drinking laws for US service members. Doubt many of them will come to fruition...but they're considering it.

    I disagree. Alcohol is already one of the main contributors to idiotic behavior by junior enlisted. Allowing 18 year olds to drink freely is a recipe for disaster. The majority of kids coming into the military are venturing away from their parents for the first time. They are getting their first taste at making personal decisions and being solely responsible for the consequences. We all know for the most part they make bad decisions as they find their way. Be them financially, relationship, or behavior related. Add free unlimited consumption of alcohol would only lead to even more alcohol related incidences. You only have to look as far as Korea to see that allowing 18 - 20 year olds drink is not the best idea.
