GUN Texas gun laws regarding carrying loaded gun in car

    So I just moved to Austin from San Diego and as such I'm very used to the communist rule I was under in CA and am still trying to figure out exactly what i'm allowed to do here in the wonderful land of freedom that is TX.

    I've read about the new law that was passed last year(HB 823) about "traveling" and carrying a gun. My main concern is when i'm transporting the gun to and from the gun range. Now in CA, I had to have the gun locked in its case with NO ammo inside the case with the gun(whether or not it was in a mag and in the gun). CA considers the gun "loaded" if you have a loaded mag simply in the same case as the gun. So is that the case here in TX too or can i keep loaded mags inside the unlocked case, but not in the gun, on the car seat next to me and still be considered "unloaded"?

    I've been searching around online but the details still seem a bit unclear.

    Get your CHL and you can leave it on the passenger's seat with a handkerchief covering it FTW

    You don't need a license to keep a loaded handgun in your car in Texas.

    No. But you can't have it concealed without your CHL. Remember the dood who got arrested for having a revolver under his gym bag in the back seat? FTMFL.

    Get the CHL and it's not an issue.

    I thought it had to be concealed...


    Edit: But I agree, he should just get a CHL and not have to worry about it.

    I spoke with a DPD officer about 2 weeks ago about this and he said that the catch is concealed like JamieZX said. He said technically you can have it laying on your lap but if you get pulled over be prepared for hassle. Regardless, he said, with or without CHL be curteous and abiding and all should be well.

    The law also repealed the "cross county" law. It used to be unlawful to carry a loaded weapon across the stated county lines. There were also some agreements with Gov. Perry and about 12-15 other states to where Texas would recognize the other state's CHL permits as legal here.

    BTW, Texas rocks.

    My opinion on that matter though...while it is legal (assuming that you can legally own a handgun, etc), I would be cautious because I'd be willing to bet that a lot of officers are not aware of the new law.

    Big ass :werd: there... Get your CHL. It's easy and it will save so much hassle in the long run.
