GUN So say you happen to misplace a tax stamp,

    can you just call up the ATF and ask for a copy of the records regarding a firearm with X serial number in relation to Mr. Y?

    It seems in my grand parents estate there is a SBS and in my grandfather's hand written notes there is mention of a tax pay to the "department of alcohol." However they actual tax stamp has yet to be found.

    So how does one proceed? Does the person in charge of the estate, provide proof of death and proof that they are in fact in charge of the estate and request a copy of the records?

    Call ATF and ask they are suprsingly helpful, the whole agency is. I got a duplicate copy of my C and R by mailing them a 1 dollar money order.

    I can imagine you might have to do a transfer to yourself on a form 4 from the executor of his estate. Does that sound right?

    The NFA people are way too happy.

    I think the problem would be that they know you have an unregistered SBS (if they have no record of it).

    Well since I am not in control of the estate, nor possession of the weapon, I am in no position to send the letter or make the call. The people in that position are either anti's or know nothings and well NFA isn't really my thing, I didn't know if a letter would be required or if a phone call would be allowed after all we are dealing with a 3rd party and a dead man.

    I figured the ATF would have to be contacted, I just didn't know in what manner and since I am not in a position to make contact I was wondering if anyone knew the proper route, since I am being asked for advise. I am at least smart enough to know not to take anything said here as legally binding. If it were me in charge I'd just call up the NFA branch and explain the situation and ask if they could look up the weapon and if I could get a copy of the record or how to go about doing it. Knowing the people in charge (which include people outside of friends and family) they would not give the right information and I be told "the ATF can't help."


    So I guess I will tell them to call the NFA branch and explain the situation and ask what needs to be done, ie documents provided (death certificate and estate records) ect and how to go about that.

    Fuckin BATFE. I sent in my change of address form for the 2ND time now for my C&R address change, and they've yet to respond. It'd probably be easier to just re-apply.

    you can call the ATF and ask them what the process is without talking about this particular estate. They'll give you an answer. First place to look for a stamp would be the old man's safety deposit box.

    That is the first place I told them to look, if they did it or not I have no way of knowing.

    The ATF will reissue the form if they have it on file, it will be a certified copy but will not have an actual stamp on it. Like others have said, call the ATF and tell them the situation. NFA Branch is much easier to deal with than the rest of the ATF normally.

    There is a one-time transfer of an NFA item for estate purposes, but I cannot remember the form. 5 maybe?

    Thanks for the offer, I don't need 'em any time soon, I was mainly hoping to get my C&R and I ordered the F1/F4s for the future.

    I ordered a form 7 CR over the phone from the ATF and almost 2 months later they send me a full FFL license application. Weak. Luckily. The forms I ordered online came a week later.
