    I'm planning on following this case closely.

    I feel bad for the guy.

    Norfolk is the same city that likes to arrest Black OC'ers - look up Danbus on www.opencarry.org

    Seems like a good shoot to me. You have a disparity of force in that two men were attacking the 1... and the fact that 1 of the aggressors had already made it clear that he was armed. As long as the shooter didn't "egg on" the fight, I believe his use of lethal force in sd claim is valid.

    Sounds like a good shoot to me. Royals was alone, the dead guy had 3 others with him AND was armed? I hope this guy gets off. :hs:

    Does this help anyone come to the realization that you do NOT need to tell your story to the police if you're involved in a shooting?

    fix'd and agree'd; but what's proper protocol? call it in, wait for police to arrive, give them your contact info, say that you'll with hold making a statement without a lawyer to represent you, then leave?

    You won't just be allowed to leave. You may be arrested. You'll at the very least spend hours "talking" to police. Those hours should be spent being quiet to the police, waiting on an attorney to arrive.

    You should call 911, say that there's been a shooting, give them your information and location. Do not say anything about what happened. You can hang up at this point if there is no other information to convey. I myself wouldn't even say that I shot anyone. Just that someone has been shot, shot at, or whatever happened. Let/make the investigators PROVE everything, including that YOU shot someone. Not that it's that hard to prove such a thing.

    Advise the police that show up that you will cooperate fully, but that this has never happened to you before, and you want to speak to an attorney before you say anything. Do not expect to only say this one time. It is likely that more than one officer will question you more than one time, attempting to get you to say something. It may be innocent questioning just to sort out details, or it may be because you're suspected of committing a crime. Apprise your family of this same thing. While they may not have the protection of the 5th amendment, your kids cannot be questioned without your presence/consent. Your spouse cannot be forced to testify against you, either. So, basically, everyone needs to and CAN shut the hell up.

    I was advised by my attorney that if I am ever in a defensive shooting to leave the phone call active and just set the phone down to be used as a recorder. Ask anyone around if they are ok, if anyone needs an ambulance, and be sure to order an ambulance for the person you shot.

    yep, if he had time to get his gun out of his car then he hadtime to get into his car and drive off.

    If he had the gun on him I think he'd be able to walk. If you have the opportunity to flee and you fight instead then you're asking for it.
