    If it's your house and the door is unlocked it doesn't matter. Even if you weren't there it'd still be burglary, regardless of whether the door was locked.

    I know the locked or unlocked door doesn't matter in the definition of the crime, I was just commenting on the unrealistic nature of someone leaving their door unlocked and having a loaded up in the chest by the fireplace.

    unfortunately in NC I would not be able to shoot in scenario one until i actually see the weapon, even though he's in my house. obviously I would not shoot in 2, and in 3 i would unload a whole mag before he hit the ground.

    Video 1 guy breaks into a home, homeowner confronts him with his weapon drawn burglar reaches behind his back - shoot dont shoot

    video 2 guy homeowner hears burglar retrieves weapon by the time homeown is in position to drop bead on the burglar his back is turned and he's running out the front door - shoot dont shoot

    video 3 suspect has homeowners husband on the ground at gun point - shoot dont shoot.

    In this part of CA, you *might* be able to walk on a shoot in the second, but you could def walk on 1 and 3.

    Definitely shoot, don't shoot, shoot shoot shoot shoot shoot shoot.

    Scenario 2 his back is to you and he is now outside, running away. Shoot him and you're going to prison.
    He poses no physical harm to you anymore. As much as you still want to do it, it would not be wise.

    Scenarios 1 and 3, fire away champ, fire away.

    for number 2 in some states, tx probably Fl you'd walk for shooting on #2. No way it would fly here in NY though.

    True. Wouldn't fly in MN either. Too liberal.
    We have a lot of gun rights, like the right to carry, but once you use it, you're gonna get grilled. Same with home defense, and especially shooting someone in the back as they are fleeing.

    even if it would fly in AZ (I guess it might), I wouldn't shoot. Too much paperwork and mess. Fine, he got something, but at least everyone is ok.
