    Ok, I think I read the context wrong originally.

    I thought that the OP was claiming that, if he walked in to his bedroom and saw a man raping his wife, he wouldn't be justified in using force. Which is wrong in states with castle doctrine.

    Looking at it again, it appears as if he was saying that, if he saw a man randomly raping another person in the street, he would not be justified in using force. Which is correct in almost all states.

    States with strong Castle Doctrine would count this as a justifiable homicide. Basically, the idea is that your home is your castle. In a few states, an intruder simply entering your house is enough reason to use deadly force, since you have no way of determining their intent until you are on the business end of a weapon.

    Texas and Colorado both have slightly different adaptations of Castle Doctrine (with TX having a more traditional implementation; CO's is known as the "make-my-day law") but allow for the same thing.

    So, per your example, (if I lived in another state and) I walked in on a man was raping my wife, I could use deadly force. In CA, you have to have an immediate fear of bodily injury/death before you can act...and the CA legal system is so fucked up and biased towards the criminals that I honestly probably wouldn't even use it then.

    Of course, "it's better to be judged by 12 than carried by 6."

    EDIT: FYI I am not a lawyer, I am just a college student who was done a pretty extensive amount of research on CD for criminal law classes

    even states without this would back you for rape

    isn't rape a felony? you are allowed to use deadly force to stop a felony in a lot of states... bank robberies, car jackings, stuff like that

    In short. Man raping your wife, in or outside of your home doesn't have to do with CD. And if you walked in on him in your home, you better make damn sure he is raping her and she's not just shagging the pool boy.

    How does a man raping your wife not have to do with CD? You haven't offered anything so far apart from comments telling me I am wrong.

    And obviously you have to make sure it's a rapist and not a "pool boy"...by using the word "rape" I was implying that the act wasn't consensual.
