    COLLIER COUNTY: The man who shot and killed a burglar early Friday morning used a sawed off shotgun, according to sheriff's reports.

    According to reports, the resident, Sterlin Misener, shot 19-year-old Patrick Allan Hutchison while he was breaking into a camper in the driveway of 91 Willoughby Drive just after 4 a.m. Friday.

    The first deputy arrived on scene and found Hutchison lying face down in the driveway. He could not detect a pulse, so he turned Hutchison over and began CPR.

    According to reports, the suspect had been shot on the right side just below his arm pit.

    When EMS arrived and took over resuscitation attempts, the deputy retrieved the weapon – a .410 shotgun.

    The deputy believed a larger caliber weapon caused the injuries on Hutchison. Another deputy retrieved a 12-gauge sawed off shotgun.

    The gun allegedly had a spent shell in one of the chambers.

    Sawed off shotguns are illegal in Florida. Deputies have not said whether Misener will face charges related to possession of the sawed off shotgun.

    Seems pretty shady to me. Not only was the bad guy out in his driveway breaking into his camper (I interpreted it that they home owner was not in the camper at the time), but he lied to the police about the weapon used in the shooting??

    they lied probably because the knew the sawed off was illegal.
    what they were doing with it in the first place is pretty shady, though.

    Shoot sounds to be clean by Fl laws, but I don't see that stopping the feds hitting him with the NFA charges.

    I knew a guy who shot someone with a sawed off shotgun. Police just took his weapon and that was it, but this was in 1993 so ATF has become bigger dicks since than

    I suppose it depends on the state. I know in most states, you cannot shoot someone to protect your property. You can shoot someone for breaking into your home, or for trying to steal your car w/ you (or a loved one) in it... but otherwise, they have to be presenting a threat to your (or someone else's) life of physical well being.

    whatever... I'm not going to shed a tear for 1 more criminal killed.

    I've seen similar things happen here.
    Official stance is a blind eye if it's a clean shoot.

    ^ yea i was going to post this cause thats what I think, I could careless about the criminal, but i would assume the guy will go to jail cause his life was not threatened. As for the trailer being broken into, thats why you have insurance. He could have confronted the burglar and the burglar charged him though
