GUN Question regarding a FTF transfer of a revolver

    Backstory:

    I bought a gun on GunBroker from a guy within driving distance of me. I told him I'd drive to meet him, give him the cash, and we could save on shipping and going through an FFL since, as I understand it, you don't need to go through an FFL for a FTF transfer.

    The guy sends me an email saying that doing a FTF is ok by him, but that I'd need to pay his FFL the $25 transfer fee.

    Should I tell him to piss up a rope regarding the transfer fee? I thought all that was required to cover his ass (should the gun ever be used in a crime) was a bill of sale?

    Thoughts?

    Check your local laws regarding transfer. The only reason I can see him asking for the fee is if the revolver is in his FFL's possession for a consignment sale.

    Personally I think one should tell the people who want a receipt to piss up a rope. Obviously every seller feels differently, you've already agreed to buy it so I say take it as a lesson learned.

    If he didn't say this in the auction, it is a bit outlandish to expect him to pay the fee if he didn't know about it up front.

    The fee is only $25 (in comparison to the $1425 I paid for the revolver) so that's not a big deal. I'm going for the principle of the matter though. I think in Ohio all you really need is a bill of sale.

    You shouldn't need to do a FFL transfer if it is in the same state... Some people want to do one anyway just to be safe (make sure you aren't a felon or something)... However, if this was not agreed upon prior to the sale, then I don't think you should be responsible for the fee...

    That was my thinking. If he wants to run a background check on me for HIS piece of mind, then I feel he should pay for it.

    Federal laws do not require individuals within the same state to go thru an FFL for a sale, but state laws where permitting or licensing is required might.

    Are you guys in the same state?

    I've done a couple FTF sales in Ohio before, and an FFL transfer is NOT required. To the best of my knowledge, all that is required is that you guys confirm in-state residence on your driver's licenses. I'd tell him to commence the rope-pissing.

    Yep. Ohio.

    Haven't got a chance to re-read the auction page in detail, but I'm almost sure he never mentioned that going through an FFL was a requirement.

    Yep. No FFL needed. I've done several trades at gunshows, just make sure they are of age and live in the same state, good to go. Don't even need a reciept, although it's not a bad idea.

    Only reason to pay the FFL is if it's on consignment. If it is then all he has to do pick it up and theyll have him fill out a form 4473.

    It's not needed in Ohio, I live in Ohio and have done several FTF deals. All he needs to see is your drivers license or ID to make sure you are legal age to purchase.

    Yeah, dad's buddy bought one a few years back. Shot it a few times. Although when I shot it, back then I didn't have enough money to shoot it more than 10-15 rounds, lol

    Yea, my dad just bought one about a month back and after shooting his, I just had to have one. And of course, I'm too difficult and picky and had to have the black Performance Center model, which bring in a premium. :wtc:

    The 460 and 500 are strangely addictive. Almost like a "oh yeah give it to me again" kinda way

    Conclusion:

    Got ahold of the guy, finally, and tried to explain to him that an FFL isn't needed in Ohio for a FTF transfer. His response (which I was afraid he was going to bring up) was, "Shipping is $50 per the auction details."

    If that be the case, then I would have another $20 in it for me FFL to receive it. So, I just told him I'd cut my losses, pay his FFL the $25 for his 'papertrail' he insisted on having, and I'll be picking it up at 11am Friday morning.

    Such is life. Live and learn and never buy used if at all possible.
