    Cop mistaken for burglar, is then wounded by friend

    An off-duty Huntsville police officer was shot in the shoulder early Saturday when a friend mistook him for a burglar.

    Police Chief Henry Reyes said Tony McElyea, a Strategic Counterdrug Team agent, decided to surprise a good friend and former police academy cadet at his home in the 1300 block of Virginia Boulevard.

    McElyea, his girlfriend, and the friend's wife snuck into the home at about 2:30 a.m.

    McElyea walked down the hallway and started shouting "Wake up, wake up," at his friend, Reyes said.

    The friend, who Reyes said didn't immediately recognize McElyea, grabbed a .38-caliber revolver and shot him.

    "It's just one of those things where he got startled and reacted," Reyes said. "It's unfortunate that it happened, but it's fortunate that it's not any worse."

    McElyea, 28, was in the surgical intensive care unit Saturday afternoon but is doing fine, Reyes said.

    He has been with the Huntsville Police Department for 3 1/2 years.

    The incident has been ruled an accident, and no charges will be filed against the shooter, whose name was not immediately released.

    Yup. And the new AWB proposed right now actually leaves a provision for retired LEOs to still be allowed to have them since they are much more qualified to own one than the rest of us.

    I'd say it seems like 90% of the stories of accidental shootings or ND's that make it to the newspaper then onto this forum are about police officers.

    :dunno: I think the ones I post break down to about 40% LEO, 40% drunk redneck, 20% other dumbasses.

    I wouldn't really call this an accidental shooting, the cop was shooting at some dumbass in his house at 2am and he hit said dumbass.

    He shot an intruder in his house at 2am. If one of my friends is busting in my house at that time, I'm not going to walk up, check and make sure it's someone I know, then put my weapon away.

    That's asking to get yourself killed

    I dunno, it sounds like a whole story to me.

    There's just things in life you don't do and people shouldn't need to tell you not to do them;
    -don't stick your cock in the garbage disposal
    -don't dangle your feet into the alligator pond
    -don't sneak into the house of a guy who sleeps with a gun under his pillow in the wee hours of the morning.
    -don't accept a BJ from a girl who won't let you put your hand down her pants.

    it wasnt an accidental shooting, he hit exactly what he was aiming for. Its the other guys fault for breaking into his house to "suprise" him.

    BTW, the shooter was not a cop, at least it doesnt say so in the story. It says he was a FORMER academy cadet, which tells me he is not an LEO.

    I read it wrong the first time too, but that was pointed out to me. He probably was released from the academy cause he could actually hit what he was aiming at when he wanted. :big grin:

    Doesnt change the fact that the actual LEO in this case was a supreme dumb ass for going into the guys house at 2 in the morning.

    It's case on case basis. however, i know for the fact that police dept will be sue by the defendant even if the shooting is justified because everybody knows police dept has a deep pocket
