    LOS ANGELES – An off-duty Los Angeles police officer who was paralyzed after his young son accidentally shot him in 2006 filed a lawsuit Wednesday against the manufacturer of the gun involved in the accident.

    Enrique Chavez of Anaheim was shot in the back by his 3-year-old son after the boy grabbed his father's Glock 21 – a .45 caliber semi-automatic pistol – from the back seat of his pickup truck.

    The lawsuit, filed in Superior Court, alleges that Glock Inc.'s gun was dangerous because its safety device was “non-existent or ineffective” at preventing an accidental shot.

    Chavez, 35, is also suing the manufacturer of the gun's holster and the retail stores that sold him the gun and the holster. He bought the gun at the Los Angeles Police Revolver and Athletic Club and purchased a holster made by Uncle Mike's and Bushnell Outdoor Products from Turner's Outdoorsman.

    The lawsuit alleges the defendants knew the safety device was defective and that 5.5 pounds of pressure on the trigger frequently results in accidental discharges.

    The lawsuit alleges product liability, breach of warranty and loss of consortium, and seeks general, special and punitive damages, and attorneys fees.

    Calls made after business hours to the defendants were not immediately returned Wednesday night.

    woahhh, are you trying to tell me that the gun manufacturers made it so the gun went off when you pull the trigger?? i can hardly believe they would show such neglect.

    if anything he should be charged with child endangerment. it's his fault his 3yo got the gun any damn way.

    Wouldn't a revolver and a $500 custom made "Mitch Rosen let me buy this after raping my mother" holster still have resulted in the same thing? It seems like negligence is the problem, not the gun or the holster.

    Actually it's a felony in the state of California to leave a gun in a position where a child under 18 can access it and it results in death or injury to any person unless the gun was locked with a government certified safety device.

    It's a desperation lawsuit. It's likely the guy has massive bills from his injury and has run out of any other means of paying them. I can understand that in an extreme circumstance. The lawyers that led him to this path on the other hand will probably extract a significant cut of any settlement to the case to fund the lifestyles they have grown accustomed to by exploiting the suffering of other people. Ultimately, the plaintiff and the defendant both get the shaft and the lawyers get a nice stack of cash.

    That's how I see it going down. Glock may settle for some nontrivial sum to avoid the spectacle that the plaintiff's lawyer(s) will snarf down.
