MMA non cage question got into an accident

    Basically this is the scenario. We have this neighbor that has a big suv and he doesn't park on his drive way he always parks on the side of the road. I'm not sure but people are telling me we aren't supposed to park on the side of the road we have to use our drive way. The guy has been told by other people several times.

    Its kind of dark on our street and he has a black SUV. So my friend pulled out and he didn't see the car and hit the side. It isn't to bad and my friend offered to pay him cash if he wanted. The guy didnt want to get the police involved but wanted to get the insurance involved. Im thinking because he knows he will be found at fault because hes not supposed to park there.

    How do you think we should handle this because I inevitably will get the blow back because Im the neighbor. My friend feels bad about it but who knows how he is going to feel about it tomorrow especially after he finds out the guy isnt supposed to park there.

    How should he handle it and how should I handle it?

    maybe your friend should swap insurance info with your neighbor...then say "thanks, i'll have my body shop send your insurance company a bill for illegally parking on a road meant for driving" :bigok:

    ripper has me on IL but ill help him out anyway.

    from experience as an insurance claims adjuster: regardless of the legality of the parking spot, to the insurance companies your friend still is at fault for the damage to your neighbors vehicle.

    with that said, feel free to proceed however you see fit with the situation.

    Probably not Illegal to park on the side of your road unless it has marked signs there or the curb is painted differently (ie. yellow).

    that's what i figured...

    but what if someone is broke down on the side of the highway, and their car isn't all the way in the brake-down lane, it's dark out, they have no flashers or orange safety triangles or flares or anything, and someone driving in the normal driving lane clips them. who is at fault? does the owner of the broke car have any responsibility to get their car off the road?

    not at fault apparently theres a sighn there that says not to park ther. I called ins and they said they werent paying out because right in front of his house theres a sighn not to park there. We called the police to make sure and document and they found him at fault and wrote a ticket

    mhmmmm i think the neighbor knew about it to because when we asked to make a police report he was really firm about not doing it. He didnt want them involved at all. At first I thought he was being nice but in hindsight I think he knew what was going to happen.

    The next day my friend gave him his insurance information and his wife was talking about how she bitched him out because he wasn't supposed to park there and she told him not to. There was even a sign right in front of where he parked that said no parking on the side of the road. I had never noticed it but apparently its been there for thirty years lol.
