    No charges in stolen car death

    No criminal charges will be filed against a 61-year-old Kennedy Heights man who shot and killed a teen who had stolen his car, Hamilton County Prosecutor Joe Deters said this morning.

    Deters said he declined to bring the case of Benny D. Hall Jr. before a grand jury.

    “It is a tragedy that this 14-year-old boy lost his life during this incident,” Deters said. “Mr. Hall has a right to protect himself with deadly force if his life is in danger.”

    Deters said Hall shot Quavale Finnell as the youth stole his car and tried to run him down.

    “Hall, with the car headed directly toward him, shot into the car and killed the driver,” Deters said.

    Police said Hall, the owner of a home on Odin Avenue in Kennedy Heights, went outside at 6 a.m. Oct. 23 to warm up his car and went back into his house.

    When Hall came back outside, he saw someone driving away in his Ford Taurus, police said. Hall fired at the car.

    The first shot hit the front tire and the second shot hit Finnell, severing his aorta.

    Police said Finnell turned around in a dead end and sped away down another street before he crashed into a parked Kia and a fire hydrant.

    The car finally came to a halt with its rear wheels on an embankment wall.

    “A 14-year-old lost his life here, but he engaged in conduct that placed his life in jeopardy,” said Deters.

    Finnell was an eighth-grader at Central Fairmount Elementary School, on the city's West Side.

    IIRC the Taurus is actually one of the top ten most likely cars to be stolen.

    Maybe my tin foil hat is on too snug but this seems misleading. He shot a teen who tried to run him over.

    I thought the same thing, maybe we both need a bigger size in the foil hats?

    I also found this really misleading.

    It makes it sound like he came out of the house and started firing on the kid while he was driving away.
