    AURORA - A man will not be charged for shooting and killing a man who was trying to break into his home.

    Lawrence Kintz shot 54-year-old James Edward Cannon after Cannon climbed through a window into a home in the 1700 block of North Fulton Street on July 18.

    Cannon died of a single gunshot wound to the upper torso.

    Adams County prosecutors have determined that Kintz was justified under Colorado law in using deadly force to defend himself against an intruder in his home.

    State law allows residents to use deadly force when they have reason to believe an intruder might harm any occupant of the home.

    (3) Any occupant of a dwelling using physical force, including deadly physical force, in accordance with the provisions of subsection (2) of this section shall be immune from criminal prosecution for the use of such force.

    (4) Any occupant of a dwelling using physical force, including deadly physical force, in accordance with the provisions of subsection (2) of this section shall be immune from any civil liability for injuries or death resulting from the use of such force.

    Thats the right of the people who live in those states to do so. The independence of the states is what is supposed to keep us safe from a overly powerful federal government. Keep government as small and local as you can or you will pay the price eventually.

    You know I've always been torn. I think some of our rights are so important that they surpass the need for standard federal law and need to be written into the supreme law of the land. I really think and amendment dealing with when life starts and ends might just be necessary for cases like abortion, assisted suicide, vegetables, etc. The decision in Roe v Wade is based on several amendments to the constitution, not standard federal legislation. I'm not entirely convinced I agree with the justices decisions on that intrepretation though. As it is now while I like what they did, I probably 60% likely to say its still a state's rights issue.

    When it comes to our second amendment rights the states should NOT be able to interpret them however they want. I agree that there are several issues that the federal govt should keep their noses out of but when it comes to something that relates directly to the constitution then the states shouldn't be able to do whatever they want.
