First of all, I bought this today :

Second of all, I did buy it with the intent to shoot it as-is, and perhaps add a suppressor, Gemtech and AAC have an adapter for the factory threaded barrel already.

Anyway, question is about the tax situation if I ever wanted to add a stock. Does this require a form 1 and $200 tax stamp and a modified serial?

What about if I added a stock AND swapped the barrel for a long barrel?

Just hypothetical (mostly) at this point.....

SBR is one stamp at $200, Suppressor is another at $200.

nope. 2 receivers = 2 different guns. Just like if you bought an ar pistol and another whole ar.

To recap from the other thread: If you're going to add a stock you need to fill out a Form 1, Pay $200, and get your name/city/state engraved.

what about having a rifle receiver (build to 16') and an SBR upper with no receiver?

Isn't the ATF trying to equate possession with intent though?

So I can swap the barrel with a long barrel with no tax issue or form 1?

Once that's done, can't I add a stock also? Or is it the serial # that is listed as a pistol or rifle? Just looking at it, they wouldn't be able to tell.....

No paperwork was filled out at purchase, I gave the dealer my money and walked away with the gun. :dunno:

It sounds like you just want a rifle. It would be cheaper and easier to just buy an extra one, or look for a trade.

If you swap in a 16" plus barrel, yes, you can legally add a stock without any of the Form 1 stuff. That was only if you wanted to add a stock with the existing sub-16" barrel.

If the gun was in the dealer's own name, that was a legal private party sale. If it was in his business name, he was supposed to do the NCIC/paperwork. If he had it on consignment, then you'd be in the inbetween area that I :dunno:

A pistol can be converted into a rifle and freely swapped back into a pistol configuration as long as the rifle configuration is "temporary". The only time you get into a gray area is when you have a lower that is on record as a rifle and want to assemble it as a pistol. In that case, you would have to do the paperwork to build a AOW.

Maybe it's easier to find the rifle barrel and stock than it is to find the pistol barrel and cap for that gun? :dunno:

Reference the Glock carbine conversions. People swap those around all the time and I have yet to hear of anyone arrested for doing so. If you still own the "pistol" parts, the carbine conversion is a legal and temporary configuration.

The letters you linked say (in Pg1) nothing more than a gun is legally a "firearm" subject to regulation in certain configurations by the NFA regardless of whether it is a pistol or a rifle. And (in Pg2-3), that to take a gun that is already a "rifle" and turn it into a "pistol", which as I already stated, would be creating a SBR or AOW under the NFA. Neither addresses the issue of configuring a legal pistol into a non-SBR rifle and back.

I'm not a lawyer, and I'm not the ATF. Anyone looking to do these things should be aware of the firearms regulations in place in their state and have any necessary questions answered in writing by the ATF.

Just keep the butt stock @ a friend's house while it's in pistola mode.

2nded- You should have just bought the rifle.

Like Kelly said, that's starting from a rifle receiver and making it a pistol, not starting from a pistol receiver, making a rifle and going back to a pistol.
