I was trying to delete a file out of the trash can. It would delete it said that the file was still in use. Me being OCD i wanted the trash can to be empty.

I think you can fix it just by recreating the Trash folder?

    mkdir ~/.Trash
    chmod 700 ~/.Trash

The second command will set the permissions.

Try logging out and back in? Also maybe Repair Disk Permissions with the Disk Utility app?
