well, i would send an email stating that you are very flattered, but as the owner of the photo you did not receive any request to use you work or compensation.

and if you have it CRed, you have a stronger case if they refuse to pull it down or blow you off to seek compensation via legal channels.

Already contacted the owner. Asked him to either credit the photo or take it down. He said do the former. Not looking for money.

Yeah. Get that taken down or get some money.

You might also tell them they should also look into getting somebody decent to do their graphics. That shit is nasty.

I always loved your work on WMD, you should get paid for that. Fuck credit. A compromise would be them paying you with a complete AR.

Some serious business in here. So for future reference, what would fair compensation be?

    look at it this way.

They are making money off your work. If they were to have contracted you to shoot this product for them, would you have done it for free? I surely hope not. So why should they get it for free now? Fuck photo credit. Id rather get paid and not have the photo byline, then to have the biggest byline and get no pay.

Photo credit is overrated. If i wanted to see my name in print so bad, i'd type my name in Word, and print it out. Get paid for your work.

And that has what - EXACTLY - to do with having a modicum of common business sense? :ugh:

You can't pay bills with a fucking photo credit, and giving work away for nothing contributes to the devaluation of the industry. When good quality work is available for free, they why would a prospective customer pay for it?

Jesus christ. Take a business class before you post again.

WHAT you charge really depends entirely on what they purchase.

Do they purchase the full rights to the photo to use however they want (it seems they already are)? Do they want to use it for 6 months? a year? etc

Your first step should be to contact them and tell them you've noticed they're using your work, mention that it is without permission, and ask that they remove it. If they don't remove it, the next step is to seek compensation.
