GUN misdemeanor but expunged v. can i purchase?

    i have a specific misdemeanor that doesn't let me purchase a firearm, but it has been expunged. anyone know if the expungement lets me buy a firearm or does it not matter?

    You should be able to, possible durring NICS check it could come back delayed I guess.

    class ended 3pm or so
    flight at 430pm
    thanksgiving 2003
    packed quick
    had a knife in a pocket in a backpack
    misdemeanor was weapon in sterile area
    guilty, did fines/volunteer
    got it expunged

    yea, if it's expunged it's expunged.

    I mean, that's the whole POINT of getting it expunged so that it doesn't affect you any more.

    NCIC run under purpose code J will reveal expunged charges.

    I didn't say it wouldn't "show up". But if it's expunged they can't use that information as "negative" to deny you.

    but why would a misdemeanor limit your ability to purchase anyway, i though it was just felonies

    misdemeanors involving violence will disqualify you.

    b. Are you under indictment or information in any court for a felony, or any other crime, for which the judge could imprison you for
    more than one year? (An information is a formal accusation of a crime by a prosecutor. See Definition 3.)
    c. Have you been convicted in any court of a felony, or any other crime, for which the judge could have imprisoned you for more
    than one year, even if you received a shorter sentence including probation? (See Important Notice 6, Exception 1.)

    b. only applies if you're pending trial.
    c. only really only applies for felonies since a misdemeanor is punishable by up to 1 year -- not more than 1 year.

    i. that is what really applies.

    yes, i know. i was just pointing out that SOME misdemeanors CAN restrict your ability to purchase a firearm :dunno:

    i think that means misdemeanor crime. specific to domestic violence, yes, but still a misdemeanor
