A&P is this normal? v. confidentiaity agreement

    volunteered to shoot some free pics for a friend of mine who is part of a pretty big organization here in atlanta.

    i get an email today with a contract/ confidentiality agreement to sign and bring with me. it bugged me for a few reasons -- maybe i'm being picky.

    they told me to print a copy and bring it with me - shouldn't this be their responsibility to print one out and have it waiting for me? why should i have to bother when I'm already volunteering several hours of service, etc.

    2nd, there was a clause stating the following:

    maybe this is normal, or maybe they are just trying to cover their ass, but I don't like people telling me what I can/ cannot do with my photos. if i want to use these for any reason, why shouldn't I be able to (assuming I'm not bashing their organization)...

    thoughts? maybe I'm being unreasonable...

    don't photographers want 1 of 2 things? pref both?

    money or use of pictures. you are getting none. why bother?

    seriously, they want you to volunteer for absolutely NO reason when you already have a portfolio good enough to get paying clients? you should tell them to shove it :o

    you make them pay MORE for exclusive rights. If they essentially own the copyrights, thats work for hire, not volunteer

    i would never sign that unless they are paying me to do so.

    ever.

    you are giving up all of your rights as a photographer, FOR FREE.

    Think about it. They're going to take your work, and use it at their will to promote/advertise/sell their organization, but they're asking you to give up your right to do the same, AND they're not compensating you for your time or compliance.


    fuck that.

    I would require them to pay me a signing fee, AND have them add a line that states they will credit you ON THE IMAGE any time, any where, any place they use one of your images.

    or you take the pics, sign that, then charge them $5000 for the DVD :naughty:

    or if you don't mind wasting time, send them a dvd full of heavily topaz adjusted images

    Unless they're paying for your Opportunity Cost you'll be losing out on, I wouldn't be signing squat.

    first off, I am doing this because i wanted to help out and give back to this organization, since it is a cause I can appreciate.

    as far as me using the shots: i spoke with the director and she expressed her concerns about individual identification of the children and why that was inapropriate. she said i was welcome to use any large group shots or shots without kids faces (which will be ok since there will be some celebrities working with the kids who I can shoot).

    she also agreed to work in photo credit for any reproduction of the image.

    so I think thats good. I'm also getting my name put on their sponsers banner which is pretty cool. I think it will be fun. its only a few hours of my day - doin it for the kids :hug:

    So were you volunteering cause you wanted to do something good, or cause you wanted to be able to say, " hey, look at me, I help out in the community"? In other words, were you doing it to change/uphold the perception that people have of you or out of the kindness of your heart?

    apparently not all photographers. there's more to life than money....

    I really don't care to use any of these photos. I just don't like being told what I can/ can't do with them. that was my only concern.
