you don't have a ccw, first off.

you just arrived into a mall parking lot after target practice at the range. your gun and ammo are locked inside your trunk, both locked separately from one another.

while walking towards the mall entrance you notice people running from the mall, shouting that there is a man waving a gun in the air and shooting at people....

you hear gunshots and you see the man with gun in hand...

what do you do in this situation to save lives but avoid murder charges?

    justttttt curious

Well if I didn't have a ccw I wouldn't do anything since I'd already be breaking the law leaving handgun unattended in a car.

    oh snapples

  7. I'd get back in my car and leave. It's sad, but with all the lawyers just waiting to file lawsuits, judges and juries ready to hand down absued decisions, and brain-dead politicians who won't do anything about it, it's just too expensive to risk doing the right thing.

so you're actually going to the mall to pick up your little brother and you notice him injured from a gunshot wound...

at what point do you say fuck it and then go chargin' in, firing your weapon?

Not to mention the fact that you may get shot yourself by someone like you that's trying to stop the same situation.

he text messaged you with, "im hit can't move."

  15. Who knows. That wasn't part of your original scenario. I'd imagine I'd try to get to him and get him out of there. If the bad guy was still a threat to me or my brother, then I imagine I'd try to stop him.

I would make sure my family/friends had a secure means of flight. Unless the "assailant" came in way of me "fleeing" I am not in a position to engage. But if placed in a situation, I would use vocal commands loud enough for "witnesses" to understand my intentions and engage if necessary. If time permitting, I would assess my backstop, to ensure no innocent people are in my line of fire, as well as possible cover opportunities.

After the situation, I would then pass my wallet and cellphone off to my wife/friend/family and have them contact my attorney via his business card in my wallet. Never give a statement on the scene, regardless if you feel it was justified or not. Secure your "witnesses" and wait for your lawyer and do not "holster" until appropriate authorities are on the scene.

Unfortunately, the "fight" does not end at the scene, and you've got to understand what is expected to ensure you live through the inevitable fight ahead of you in court. Justified or not.

What's the reasoning behind this? I always figured it'd be a bad idea to have a gun in my hand when the popo shows up.

Because I understand it's hard to assess, under a time of stress when the threat has truly been stopped. It's entirely possible he may not be alone and a bead may already be on you from his partner. The fight for me, doesn't end until sufficient "back up" can secure the scene for me.

You don't have to stand there waiving your gun around. I'm going to reload my clip, stand at low ready, better my awareness, secure a better cover if need be until the police can secure me and the scene. Because I do not train on "unarming" the hopefully "downed assailant" and will not approach him. I will only cover them from a secured location and allow someone more trained to do so. My focus is to remain alive and to ensure my friends/family are as well. They have a protocol of engaging me when they arrive on scene, and I'd rather trust that they can effectively do that, than think the fight is over.
