GUN Homeowner Arrested For Killing Alleged Burglar

    Homeowner Arrested For Killing Alleged Burglar, 15

    (CBS) BELLFLOWER A man suspected of fatally shooting a boy, 15, while the victim was breaking into a shed behind the man's Bellflower home was arrested on suspicion of murder, sheriff's deputies said.

    Deputies responded to a burglary call at the home in the 8500 block of Park Street at 6:25 a.m., according to the sheriff's department.

    Homeowner Jerry Cress, 57, told deputies he confronted two suspects, one of whom had a hammer, Deputy Anthony Moore said.

    He said that in fear of his life, he opened fire with a pellet gun, Moore said.

    Shortly afterward, deputies at the Lakewood Station got a report from a hospital about someone with a gunshot wound who died, Moore said.

    The victim was Jacob T. Walker of Paramount, according to the coroner's office.

    Cress was later arrested on suspicion of murder, according to the sheriff's department.

    Duane Berry of Paramount, believed to be the victim's brother and accomplice, was also arrested on suspicion of murder because a death occurred during the commission of a felony crime, Moore said.

    Both suspects were booked at the Lakewood Sheriff's Station and were being held without bail.

    Authorities would not confirm reports that the boys were trying to steal marijuana growing behind the home.

    If it was a pellet gun I suppose with the high powered ones if you hit someone in the right spot.

    I'd believe it about the pellet guns. My old pellet rifle would easily go through metal.

    Cress, who supposedly has Stage 3 liver cancer, had about 15 pot plants growing in the shed, KCAL reported, though sheriff's deputies would not confirm that. Cress apparently told deputies he fired at the trespasser with a pellet gun. Berry, however, told authorities he and his brother were simply walking by the shed when Cress shot at them, Channel 9 reported.

    Neighbors told television station reporters that Cress, who has razor wire ringing his back yard, had complained about being burglarized before.

    An autopsy on the boy is pending.

    Jacob's mother Yolanda Rice told the Los Angeles Times she saw entry wounds in Jacob's right shoulder and his lower back.

    ''I just don't understand how somebody could shoot somebody, even if he thought somebody was on his property,'' she said.

    Rice said her older son recently was released from jail and was charged with the alleged sale or furnishing of marijuana, the newspaper reported.

    I believe he was fucked before ;)

    This does seem to be a really unusual happening though. An old man claims self defense versus 2 guys with a hammer. The hammer may have just been a tool being used to try to break into the shed though and may never have been raised against him, he was also committing a crime himself....

    I remember when I was 10 or 11 and looking at some of the guns. I showed my dad some of them and he was like, "Jeeze, with the size of the pellet and the velocity it's just like a 22."

    wait... the shed is in a backyard protected by razor wire and they were just walking by the shed? And one of the kids had just gotten out of jail? Sounds like a load of bullshit to me.

    That pellet gun that was linked looks an awful lot like mine. If it was made in china with some chinese lettering on it then it is the same one. I picked mine up for $25 at the local gunshop just cause it was so cheap and had a solid wood stock. Turns out the thing is a tack driver and pretty damn powerful. I haven't chrony'd it or anything but I'd venture to say its in the 800fps range. It takes out little critter rather effectivly.

    Mabye I missed it, but did the guy call the cops right after the confrontation. If he didn't, a simple phone call could have probably saved him the trouble of all of this. The incident would have been documented and the police would have been on the scene.

    The guy would need huge pockets to stuff 5 whole plants in there. If the guy was smart he would put the key on the kid. Textbook trick to getting into a locked gate is to wait for it to be unlocked then replace it with your own lock. Then he can say the kids must have been growing the weed in there without his knowledge.

    Theres a thread going on about this over on arfcom someone over there said the guy had permits :dunno: In NY i dont think it would be legal under any circumstances but california probably is legal fucking hippies.
