MIL *HELP!* Trying to return to civilian job after basic/tech school (ANG)

    I left my job for 126 days, 106 were for training, 4 days were for drill, the other were for personal days and for a vacation.

    I worked a "full time" part time job for a city government in NY (they make us work 35 hours a week to scam us from benefits) for 2 1/2 years with the same assignment. No contract signed, but work was guaranteed.

    I left verbal intent for return when i left (which was agreed to verbally by my boss, who is in charge of hiring/firing my position/peers), followed by a written letter of intent 60 days before i was to return. I came back today and they said they will not rehire me in my previous position, but would in a watered down position with less hours as they "filled" my previous position with a person who was junior to me when i left (2 years junior).

    I was told that the law protects guardsmen/reserves civilian jobs for 180 days from time they leave and upon return, they are protected from being fired or having their job changed for 90 days.

    I'm basically being left without a job, as now I am subject to "rehire"...why would they put me through all this BS if they were going to keep me...catch my drift? What protections do i have under the law? I was in good standing when i left, never been in any serious trouble, etc. Anyone?

    It's called the Soldiers and Sailors Civil Relief Act (SSCRA), and you need to invoke it yesterday.

    That one is for dealing with debts, mortgages etc.

    you're looking for the Uniformed Services Employment and Reemployment Rights Act and it says that they employ you in a position of equal or comparable status that you would have attained. Not sure as to how this apply to a part time position though.

    It is the Servicemembers' Civil Relief Act. Also look into the Uniformed Services Employment and Reemployment Rights Act.

    Should i use a JAG or a private lawyer? My employer (the city itself) is notorious for messed up hiring practices.

    Good thing my employer is good about that stuff. After I was gone on orders for 212 days, I had 90 days to return to work. Took some time off and then went back. It was great.

    But yeah, contact your local JAG.
