CNN is running "whats at steak" [sic]
this dumb cum hog said that the courts have always said it says "the military can have guns"
today is either a day to celebrate or prepare for confiscation when Osama bin Obama takes office
i just hope it is affirmed as an individual right so the fucking faggot liberals can stop spewing non-sense that the "right of the people" part doesn't exist, even though it is clearly written
We'll endure bros
supposed to be live here in 20 minutes:
Won't be today, maybe thursday.
Edit: nope read it wrong, it may be today still.
No more opinions today.
That bodes well!
Scotusblog keeps pointing out that Heller is the only remaining decision from March, and that Scalia is the only justice without a majority opinion from March.
I'm not sure if that is any historical indication... but if Scalia writes the majority for Heller that bodes very well. (but I'm still prepared for the worst)
EDIT: Damn, beat to the punch.
Tom Goldstein - The only opinion remaining from the March sitting is Heller. The only Justice without a majority opinion from that sitting is Justice Scalia.
maybe that is a good sign
They'll probably wait till Thursday. Which may be bad.
I don't know the SCOTUS procedures well myself, but I can't imagine they are waiting for the last possible minute to release this before they take off because it's good news....although it could be because they don't want the brady psychos rioting.
It's common for them to release their biggest decisions later than other decisions. This doesn't mean anything one way or the other.
Does Scalia seem like he's for or agains the 2nd?
For, no doubt.
"Tom Goldstein - The only opinion remaining from the March sitting is Heller. The only Justice without a majority opinion from that sitting is Justice Scalia"
Maybe I'm reading this wrong, but I take that to mean that he's in the minority, and if he votes for it, then that would mean the others are the Majority, and that they voted against it.
He means Scalia is the only justice that hasn't yet written a majority opinion. That means that he believes that Scalia is writing the opinion for Heller, which would be a very good sign.
This is from that site too:
Right. The Cheif Justice (Roberts) typically assigns who will write for the majority. Lots of factors go into his decision, but the largest is usually which Justice will write an opinion that the other Justices in the majority are willing to sign on too. Otherwise you end up with one or more "concurring opinions" written by other justices, which mean they agree with the judgement, but not necessarily the legal reasoning presented in the majority opinion. These types of judgements usually aren't considered as "strong" as a singe majority opinion, and may be more likely to be subject to revisitting by a future court.
The only potentially bad aspect of a Scalia majority opinion is that it would very likely mean a 5-4 ruling, which again is not seen as "strong" and is more likely to be revisited by a future court.
The other reason it would be awesome if Scalia wrote for the majority is because he is usually good for a couple of wise-ass remarks to piss off the other side.
