    WASHINGTON — The plaintiff in the Supreme Court case that overturned Washington's 32-year-old handgun ban has filed a new federal lawsuit against the city.

    In a complaint filed Monday in U.S. District Court, Dick Heller and two other plaintiffs allege that the city's new gun regulations still violate rights guaranteed under the Constitution.

    The lawsuit cites the District of Columbia's unusual ban on firearms that carry more than 12 rounds of ammunition, which includes most semiautomatic handguns.

    The suit also claims that the city's regulations make it all but impossible for residents to keep a gun ready for immediate self defense in the home.

    The Supreme Court struck down Washington's handgun ban June 26. The D.C. Council passed emergency legislation July 15 in an effort to comply with the court's ruling.

    In some sense the antis are bringing their worst thought true. The federal AWB has led to what can only be described as hoarding of things they wanted fewer of. The city with the nation's strictest gun control laws has led to the supreme court declaring the 2nd amendment an individual right. The city with probably the 2nd most strict laws in the nation will likely lead to incorporation. If they had truly been the moderates on gun control laws they claim to be we might not see the demise of so many gun control laws. Yay for their greedy irrational selves.

    This one won't reach the SCOTUS, but probably the DC circuit court of appeals. DC is going to lose, again.

    The circuit appeals court found in hellers favor the first time and explicitly mentioned the guns secured in the home business.

    Yes. They are just below the SCOTUS, and are often referred to as the 2nd most important court in the country. Many of the current Supreme Court Justices served on the DC circuit court of appeals before being nominated to the SCOTUS. I think you could see an even more broad opinion in this case. I don't think the DC circuit is going to like the city council fucktards getting cutesy with a Supreme Court rulling. DC might get their asses handed to them and then some on this one.

    This is disgusting and refreshing at the same time.

    It sux to hear how fucking retarded DC is still being about one of the peoples civil rights. "Shall not be infringed" :mad:

    But at the same time its very refreshing to see that Heller is not giving up.

    Backlash?. From who? Patrol officers actually like the idea of people being able to defend themselves, contrary to popular belief. The higher ups dislike guns, but they arent smart.

    I think it's the perfect time, and I don't think he is asking to much. DC is willfully playing footise with a clear and direct ruling from the nations highest court. Fuck em, if they are going to play games, more power to Mr. Heller.

    It's unfortunate that another suit has to be filed, when this could easily had been incorporated into the original suit, and would allow SCOTUS to rule on the semi-auto/12 rnds rule as well, which probably would have given us a nice precedent to deal with. Too bad that this won't have as much weight as the original ruling, though this is probably just as much of an important issue.

    I'm sure the city council knew about this the whole time, but shame on the NRA/Legal Council that was representing him, for not including this the first time.

    Does anyone know if the cities that the NRA filed suit with days after the Heller decision, have similar laws restricting number of rounds or semi-auto capability? If they do, they need to incorporate the repeal of that wording into the suit.

    I guess it makes sense that you can't argue everything in one case, but at least they had thought about which handguns would be legal, and which wouldn't, even after upholding the lower court. Too bad that DC is too fuckin stupid to understand that they'd be saving a whole lot of money by just changing the law like they were supposed to.

    Its probably easier/safer to chip away at the issue little by little. This has been such a point of contention that to throw everything into one case would have been wishful thinking at best. It was foreseeable that once Heller was decided by the sup. ct. it was gonna open up the flood gates of litigation.
