The 28-year-old man, a Navy rescue swimmer, is charged with misdemeanor use of a firearm while under the influence of alcohol. A neighbor told deputies he heard 20 to 30 gunshots coming from the man's back yard. As he spoke, about eight more shots rang out, according to the arrest report. When a deputy walked back to investigate, he found the man sitting near the pond with a 21C .45-caliber black Glock pistol lying next to him with two magazines, one empty and one loaded. The deputy said he smelled alcohol and noticed slurred speech. Then, "while the defendant was handcuffed and sitting on the ground, he vomited approximately three times, then stated ‘I feel better," the deputy wrote. At the Shalimar annex, he registered BAC levels of .090 and .093 in breath tests, according to the report. ---- seems like the BAC level is pretty low for someone who vomits.
