Talk to an attorney who specializes in estate. Did the IRS have a lien on their property?

depending on what state you are in, yes it does.

and death doesn't excuse you from a tax debt.

He had tax trouble, we are not sure to what extent... my mom owns her house which is a co-op over 55 community so I don't think they can take from her estate..

You need an an estate attorney as mentioned by someone else.

Asylum is for emotional guidance and support. The tax laws specific to your state are a little out of our jurisdiction.

Find such an attorney, and then come back after that. We can help you with the other issues surrounding your father's death and the manner of his passing.
