WEB copyright question

    I have some userbars that I have created and members on another forum have saved the images and uploaded them to another forums servers.

    I have contacted the owner of the site to remove the images but he is not cooperating. He has actually told me to contact the specific members. This in my mind is not acceptable, it is not my job to moderate the members on his forum and I have told him this. He also doesn't think its his problem that he has copyright material hosted on his server.

    What can I do?

    He is claiming that he is not responsible for it and this is what it states in his user agreement:

    "Although the administrators and moderators of Discussion Forum will attempt to keep all objectionable messages off this forum, it is impossible for us to review all messages. All messages express the views of the author, and not the owners of Discussion Forum. Discussion Forum will not be held responsible for the content of any message. All posts become the property of CSF."

    At the bottom it stats posts are property of CSF but above it says they are not responsible.

    I have actually contacted their host as well. Is there anything else I should do?

    i would wait to hear back from the host, other than that, i would probably drop it, i mean short of hiring an attorney, i am not sure there is anymore you can do

    but does it not say THIS on your site .....

    no where on the userbar page does it say "YOU ARE FORBIDDEN TO DOWNLOAD, LINK OR OTHERWISE USE MY USERBARS FORTHWITH"

    you're like a dog barking up the wrong tree here .....

    UNLESS they've uploaded them onto userbar sites and claimed them as their own .....

    BTW, which forum/site have the uploaded them too?

    You sound like you need to lighten up.

    And a few posts up is correct. You're not allowed to use copyrighted logos in your copyrighted userbars. :rofl:

    they are able to use them on other sites but they should not be uploading them to their servers.

    anyway, the owner asked me to provide him with links to the images, so i have.

    It's all good dude, I do the same kind of shit all the time. Basically whenever I put up content I assume every user is going to be a douche bag thief and only put up stuff I don't mind being stolen. I don't know if that makes sense but it's a good rule of thumb to follow.

    so what do you do with stuff that you dont want stolen, but do want users to see or think it would drive traffic?

    dot lol. It's like saying you are pissed some guy made copies of your pirated windows vista cd you sold to him and then sold them himself.

    Though there is room for "fan art" and artistic interpretation and such. But overall you don't have much of a case at all.


    You might do better if you were friendly to the site owners and ask them if they are going to just upload the images you modified if they could give you a good link back to your site. A solid navigation link would probably be better off than a few random footer links.

    That's pretty difficult to do...there are some things like right-click protection but it's more annoying than anything else...or you could add a small url/watermark on the image, but then people might not use it. :dunno: It's really a crapshoot when it comes to that stuff, you just gotta rely on the people who copy/paste the code given to them. It's the same thing with stuff like free myspace layouts - some people remove all backlinks, banners, etc. others have no idea how.

    Yep. You're going to get a lot further in these situations coming off polite and rational. You might end up getting an ad spot/text link that turns out to be valuable to you, so just keep that in mind.

    Then if you're still not getting anywhere your only options really are either add a url on the image or just say fk it. :mamoru:
