MIL CO cited for DUI

    So the story goes as such... He was pulled over for having his high beams on (a point he argued becasue his low beams are brighter than normal in his BMW) and refused to take a breathalizer test when the officer asked if he had been drinking. He wanted to get a blood test done. BUT, apparently the whole process was taking too long in getting the test done, so either they didn't even bother with the test(this is all second hand knowledge from a buddy who is still enlisted, details could be off).


    Oh, he's still driving on base too, the very first privledge he took from everyone else in an alcohol related incident.

    So wait...let me get this straight...he was pulled over for going the speed limit and having different headlights than most other cars...opted for a blood alcohol test and by the time they tested him his BAC was lower than the limit. Sounds like he won't get convicted...let's not put the cart before the horse here people. Innocent till provent guilty folks...it's a tennant of the American constitution and the UCMJ.

    Any alcohol related incidents that I have ever seen always resulted in the immediate restriction of privledges for SNM to some degree (and usually everyone else as well), and some EPD thrown in for shits and giggles. Not to mention being on the unit shit list, which is never fun.

    Agreed. Life isnt fair, perks of the job, etc. If he is a shit hot CO, then fuck it.

    If he were SPC Watada, there would be no 2nd trial. There would have never been a mistrial.

    From what I gather his BAC was lower than the limit which is why he is being charged with a DUI rather than a DWI.

    Based on reading the first post this is what I have gathered.
    1. Col. Claypool implemented a policy on base that took away driving privileges from people involved in alcohol related incidents.
    2. Col. Claypool has been charged with a DUI, hence involved in an alcohol related incident.
    3. Col. Claypool has not forfeited his own driving privileges and continues to drive on base.
    Seems to me he's being a hypocrite and not leading by example and following his own policy.

    I am not familiar with Arizona law but from what I've read in this thread - this man will not be convicted of anything in any court of law with a decent lawyer.

    That was my first thought so I decided to do a quick search for more information. According to the MarineCorps Times he was stopped for failing to dim his lights to oncoming traffic. He then was given a field sobriety test, which he failed and has been charged with a DUI. (It actually says he has been charged with 2 DUIs but that is standard procedure to do so).

    Regardless I don't think it's appropriate for him to continue to drive if he took the privilege away from others in similar circumstances.
