I get it, you can't have NFA in California. It sucks. Fuck my life.

Seems pretty simple to me, the people who are telling LEO's to pound sand are just asking for trouble.
If a LEO sees a class 3 toy, and asks for papers to prove it's legal, and you tell him "no", he'll assume it's illegal and arrest you. By refusing to show your paperwork, he has no reason to assume it's legal. He'll be perfectly happy to let the courts worry about it.

That's where those guys are wrong. The LEO doesn't have burden of proof, the courts do.

I don't have any reason to NOT show the paperwork.

Not showing your paperwork isnt probable cause.

While I understand why people dont want to cause trouble, I think this country needs more people that dont let cops do whatever they want and push them around.

Refusing to show your insurance, registration, or driver's license when you get pulled over is enough.
    How is this different?

First of all you're making the mistake of assuming that all states have the same laws. I dont have to show insurance or registration here.

Second, most states, at least mine, dont regulate NFA weapons, thats the ATF's job. States do regulate vehicles however and thus have the right to know you're legal if they have reason to pull you over.

And even then a cop cant pull you over and check your papers (comrade) without reasonable suspicion that you've broken the law. Simply saying "he's driving a regulated vehicle, I must stop him and check if he's licensed" isnt enough.

the difference is those are state jurisdictions

why does a local or state police want to meddle in federal affairs?

the only people who should be entitled to see your stamps are the ATF... they are the ones who issue them after all

    Ahhhh, got it.

Never said they didn't need a reason pull you over to begin with, same goes for firearms. They should have a good reason to ask for my form1/4s

Yeah the problem is this question is in reference to a cop seeing an NFA weapon and that being the reason for asking for your form 1/4. It seemed like you were arguing that simply having an NFA is reasonable cause to ask to see your papers.

You actually think each state doesn't have their own laws regarding C3 items?

    As a minority, I'd hand over a photocopy of the stamp/Form 4.

Shit, even taking out the racial element, ie, if I was dealing with an asian cop, i'd still hand over the stamp. It simply remains that most people, cops included, are ignorant of the legal issues surrounding NFA items.

I keep a photocopy of my Form 4 in my VFG, and both range bags. Maybe I should put one in my butt stock and car as well...

That is not a reasonable or correct statement at all. If that is the case, who will actually enforce the law. We do not have federal law enforcement patrolling the streets to make sure we're complying with Federal law.

Enforcement of the law is a trickle down things. A city cop still has the right to make sure you are complying with a state law, which is an exact comparison to what you're saying with a local cop not being able to enforce a Federal one.

As to whether or not they have a right to just ask you to see them, I dont think they do, however, considering the "touchiness" of NFA items, I also do not see a real harm in showing if asked. I carry a copy of all my Form 4s with the guns at all times, just in case even though, by law, I do not believe this is required.

I don't show my receipt to the faggots at Sams Club and other places that check them. Had an old man who was doing it once try and stand in front of me. I laughed and said "what, are you going to stop me? I didn't steal anything. Are you accusing me of stealing??" and walked out the door

wife hates it when I do that

I really don't see why its too difficult to just take a binder with photocopies of all the permits/stamps with you when you go to shoot. The guy i know who has class III's keeps one in his gun safe and just brings it with him whenever he takes something out.

I would however, show my stamps upon request. I really don't feel like causing a scene when it comes to that.

But I do enjoy fucking pissing those receipt checking faggots off like it's fucking christmas morning

i assume we're not talking about pulling someone over and checking DL, PoI and reg JUST to do it.

the way i read that is you're ALREADY involved in a traffic stop, reason irrelevant, and the police officer (or whatever law enforcement figure) is asking for those documents.

    why wouldnt you produce them?

I produce my license if I'm pulled over, but I've never been pulled over without cause :dunno:

The comparison is that you cant pull someone over just to check registration just as you cant stop someone just to check their forms, which is what the original question is about.
