for those of you without access, basically a guy had a rifle sent to a FFL from Classic arms, FFL gets pussy hurt over the price he paid and jacks the transfer fee from $25 to $100 and threatens to keep the gun.

No kidding. I'd call that bluff in a heartbeat and tell everyone I knew they were a shady piece of shit.

Unfortunately he's probably fucked. There are no regulations, afaik, on how much a dealer can charge to do a transfer.

If I were in their shoes I'd call ATF and ask how to proceed, advise them I was supposed to be charged XX for a transfer and they jacked it up beacuse of the type of gun and/or price and refuse to release it.

    He might be fucked

if he had any record of a posted price, or even an oral agreement, it's a breach of contract, and further a trespass of chattel

They won't.... They will say that he "agreed" to that price one way or another.

Fuck those guys. I'd spend a grand before I'd give them $100. Calling the ATF and AG would be my move, then go from there. There's a dealer up north that was trying to take cash + percentage of gun "value", declared by them. I'm pretty sure they got fucked pretty hard, and now are definitely no longer in business.

I dunno. He did pay money for it already, so I'd assume he has to have SOME stake in it. Worse comes to worse, I would imagine they would send it back to whomever he purchased it from.

They're not taking it. They're withholding it until he pays a set fee for them to do the transfer. Until then it is not legally his. It still belongs to Classic Arms.

Don't get me wrong, he's getting fucked and I'd do everything in my power to ensure that son of a bitch went out of business for fucking me like that but unless he presses the fight he will be screwed out of $100 or forced to eat double shipping and have it mailed back to CA then sent to another dealer.

As stated in the original thread, if it were me I'd call the ATF while standing in front of him and inquire about who the agent in charge of his FFL is then call him and explain the situation.

  14. He should sue the FFL for specific performance + court costs/ attorneys' fees.

Overkill, but it would be funny.

I'd get in contact with whoever transferred to the FFL and let them know to not use that place anymore as they are impeding business for them. Get the gun sent back, and then go through a different FFL. Any way you handle it, it's going to be a huge headache I imagine. Shitty FFL.

Would you really not spend the $25 or whatever to ship it back if worst came to worst? You can ship rifles UPS ground, it's not that expensive.

$25 isn't dick in the scheme of things. I'd fucking doll that shit out in a heartbeat before I even THOUGHT about giving that cocksucker a dime. Fuck, I'd ship that bitch next-day air before doing that.

I'd gladly spend $100 to have it shipped somewhere else to not give them a dime

I'd debate who "owns" the firearm. Taking posession or making use of something isn't necessary to demonstrate ownership. Then again I don't know enough about the form 4473 to make a solid argument.

some people i know laugh at me for paying extra and using a chain sporting good store but that thread makes me feel less silly cause they sure aren't gonna keep my gun and hold it for ransom like what's happening to this guy

plus i'd contest the credit card charge since possession wasn't able to be carried out and let the seller deal with the FFL
