i was just at the mall and i had my gun on me, and my shirt rode up a little bit and was revealing the handle. random kid at a store asked if my P99 was a P22 :ugh: little strange, not gonna lie.

but he said that having the gun showing a little would be considered brandishing.

now my question is, in a state where you can open carry, can it even be considered brandishing if only a small portion managed to pop out of my shirt?

  2. No. And it's not brandishing unless there's some sort of intent.

But whenever people give me wrong info, I usually respond with "oh ok", and just walk away. :dunno::o

Florida law - not going to be "brandishing"

Also Florida requires a Mens Rea of knowledge for open carrying. Simply the fact that your shirt rode up is not open carrying.

If the officer wanted to he could request CWP and may tell you to better conceal other than that it's not going to turn into a big deal. Carrying a firearm offenses do not have to be comitted in the officer's presence either.

Hope that helps...Again just FL law.
