There were two big developments Monday in the case of a motorist who was shot and killed along Greenwell Springs Road Friday after a fight with a police officer. Investigators say an autopsy shows the deadly bullet was fired by a bystander, not the officer. Police also announced that no charges would be filed in the case, either against the police officer involved or the bystander who fired the fatal shot into the head of George Temple.

East Baton Rouge Sheriff's spokesman Greg Phares says Officer Brian Harrision was escorting a funeral procession Friday when he pulled Temple over and wrote him a ticket for breaking into the procession. According to Phares, that's when Temple attacked Harrison. Police say Perry Stevens was walking outside of the Auto Zone on Greenwell Springs Road when he heard Harrison yelling for help. Harrison was reportedly on his back with Temple on top of him. That's when Stevens went to his car and grabbed his .45 caliber pistol.

According to Col. Greg Phares, "[Mr. Stevens] orders Mr. Temple to stop and get off the officer. The verbal commands are ignored and Mr. Stevens fires four shots, all of which struck Mr. Temple."

Perry Stevens fired four shots into Temple's torso. Officer Harrison had already fired one shot into Temple's abdomen. With Temple still struggling with the officer, Perry continued to advance toward the scuffle.

"He again orders Mr. Temple to stop what he was doing and get off the officer. Those commands are ignored and he fires a fifth shot and that hits his head. The incident is over with, and as you know, Mr. Temple is dead."

Police are calling the shooting death justified. Perry Stevens has a permit to carry a concealed weapon. Col. Phares would not give out any more details relating to the shooting. Both Phares and Baton Rouge Police Chief Jeff LeDuff stopped short of crediting Stevens with saving the officer's life. LeDuff says the entire incident is unfortunate.

"I spoke with his father at the scene briefly," said LeDuff. "I think this is a tragic situation all around."

9 News is told George Temple has a criminal record, and Officer Harrison was involved in a shooting while employed as a prison guard in East Baton Rouge Parish, where he was suspended for three days back in 1995.

:werd: maybe its time for me to pick up a D Eagle .50 for ccw :mamoru:
I would like to know where his first 4 shots went and what ammo he was using, cause I may want to avoid using it in my G21.

This story's a serious message about handguns in general. Pistol bullets poke holes. .45ACP, 9mm, whatever... the best way to improve ballistic performance isn't by using a certain load or caliber... it's by shooting the motherfucker again.

should have activated his aimbot earlier. Could have saved himself 4 .45ACP rounds.

I think it would have been funner to jump kick the mother fucker in his face than to shoot him.

Saw the original article posted on Glock Talk and was wondering if the bystander who shot him would be charged with anything.

I don't know what to say, scratch one for the gun people, but did this guy have a weapon? maybe it would have been a better choice to just beat the crap out of the guy. :dunno:

Bullshit. He was an immediate danger to the life of the officer, and was told to stop. He refused, so he was killed.

I'm grateful that the man was able to take the necessary action and save a LEO's life.

    Get some!

Even though I can't carry concealed yet, anytime I see a police car on the side of the road that stopped someone, I always drive by slowly and just check to make sure the officer is okay and there wasn't some shit like this article above going on. It pisses the people behind me off, but I don't care.

Did any of you guys see that video which was on "america's wildest police videos" or one of those types of shows where this female officer pulled over this 300 pound thug and the thug immediately got out of his van while the officer was walking towards his car and he tackled the officer and just absolutely beat the shit out of her and drove off... it was an innocent bystander driving by who saw what happened and called 911, too bad they weren't carrying.

I'd say that was a good shoot. If I were in his (the bystander's) position, I probably would have done the same thing, but seeing as how this is Kommiefornia, I'd be in jail right now.

homie had already been shot by cop and didn't stop before being shot by the civillian. the civillian shot and wounded him with four more bullets before the fatal shot. if 5 shots don't stop him, i doubt beating on him would have much effect. bottom line.....homie didn't stop, so homie got popped.

:werd: The cop already had his gun out, you dont want the fucker getting hold of it, he is putting everyones life in danger, he did the right thing, If the cops gun wasn't in play then maybe you can consider other alternitives.

not only would you be in jail, but all the soccer mom witnesses would testify that you were trying to kill the cop and just happened to hit the bad guy.

Then the news would have a special report on a civilian pulling out his semi automatic machine gun assault rifle with grenade launcher and spraying the public area with bullets, barely missing a child's head by an inch. And of course there would be a church/playground within a few feet from the incident. The news reporter would then interview some parents of the surrounding areas and they would say "omg, I felt like it was a war zone. He just came out of nowhere and started shooting people. I was so scared for my children."
