I mean, I know you can't buy one or buy any ammo for it, but can you still possess one?

I figure that shooting one is ok at a range or whatever (assuming it belongs to someone over 21 who is legal) but are there ramifications for simple possession?

No real world scenarios I can think of, just speculation.

Varies by state, their is no federal law saying you have to be 21 to own a handgun, have to be 21 to purchase it from an FFL.

In my state anyhow. You can't legally purchase one from a FFL aka gun shop. But between the ages of 18-21 you can purchase one from a "private party". But at the same time, it is illegal in my state, to buy a firearm with intent to sell or purchase for a minor.

In CA, it is legal to possess, but not to buy at 18. So if you build one from an 80% frame, or are given one by your parents/grandparents, its allowed.

In FL you can possess. You cannot get a CCW and you cannot purchase.

In PA at least you can have a pistol if you're 18-20 if an immediate family member buys it for you or buys it and lets you as there's no paperwork needed to transfer between immediate family. So dad gets a glock and says happy 18th birthday you can have it and carry it (OPEN) but you can't get a permit to legally carry concealed till you're 21.

I just looked through Lexis Nexis at some of the statues for Colorado, in particular possession of a firearm by a juvenile, and all of the applicable laws and penalties only apply if you are under 18, not under 21.

Federal law states an FFL cannot sell a handgun to someone under 21.

I believe a FTF sale to someone under 21, who meets all the other requirements, is allowed.

I think the "purchase with intent to sell to / for a minor" is to prevent people from getting/asking/hiring other people of age to just walk in and buy, then sell off. Gifts/inheritance etc is OK... I think

Yeah, the "straw man" law or something like that. But I've seen plenty of times when the father goes in there with his son, has him handle the firearm and straight out say he's buying it for his son. So guess you are right. I didn't know the extent of it though.

Huh, how about that? So it looks like you can get a handgun from family oOR buy one over 18 as long as it isn't from an FFL.

Technically I am not a resident of CA and won't have any guns while out here (for a few years at least...not in the dorms haha) so I was just referencing CO for right now but your posts are much appreciated.

You can FTF/PPT a handgun in CA, but it still has to go through a dealer :o

In that case, how does one under 21 and over 18 get one?
