    What do you say to people who argue that the constitution is old and outdated. And therefore is irrelevant?

    How about your freedom of religion?
    And your right to a fair trial?
    etc...

    Fuck it, I feel like filling in some more:

    Right to assemble
    protection from quartering of troops
    protection from unreasonable searches and seizures
    due process, double jeopardy, etc (kinda falls into fair trial)
    cruel and unusual punishment
    protection from slavery
    right to vote


    the list goes on and on.

    ETA again:
    How about this: Without the constitution, there is nothing stopping the government from sending you to jail for saying something like "the constitution is old,outdated, and irrelevant"

    I'd say that person needs to engage a little more rational thought. There's nothing logical about such a statement.

    There were certainly people even in the 1780's that didnt believe it was right to be writing laws for future generations.

    But the argument against the Constitution being obsolete is that it contains provisions to change it, and if any part were no longer applicable legislators can change it :dunno:

    Not only that but writing a new constitution would be impossible nowadays. And our constitution was written by what has to be one of the smartest groups of people of all time, if we let the idiots elected by other idiots in modern times take a crack at it we'd be so fucked.

    End of story.

    It must be read as literally as possible and using the definitions of terms in use at the time it was written. None of this BS: "Well, sure "regulate" meant orderly and efficient then, but it means government control now." being the reasoning for continued loss of Liberty.

    If some issue beyond the enumerated powers of congress or the president is so pressing and important, then amend the damn thing. If that isn't feasible due to lack of popular support, then it must not be that pressing then.

    It would be a disaster. See Robocop 2. 3 Directives becomes a couple hundred due to political correctness and focus groups causing Robo to become essentially worthless.

    The problems we currently face are almost solely due to not following it for the last 80 years or so. It can be fixed without throwing the baby out with the bathwater.

    Might I point out that the original Constitution, as written, did not contain the bill of rights because the Federalists believed that the three branches of government would actually exercise power within their limited and separate powers (and thus had not the power to take rights). The Anti-Federalists believed that power corrupts and thus insisted on a Bill of Rights to at least protect the most fundamental rights.The Federalists believed that was a bad idea since specifying certain rights might lead to those being recognized as the only rights, hence the ninth amendment.

    And here today we have whet they both feared: Government ignoring its limits on power AND curtailing of rights simply because they aren't listed in the BoR.

    Is that someone crying "Havoc!" I hear...?
